ShiftPosts Privacy Notice

Effective date: August 1, 2022

FourQ Technologies (“ShiftPosts”, “us”, “we”, or “our”) is committed to protecting your privacy. This Privacy Notice explains how we collect, use, and otherwise process your personal information in connection with our websites that post or link to this Privacy Notice, including https://shiftposts.com/ (the “Sites”), the ShiftPosts mobile applications (the “Apps”), and our services offered in connection with the Sites and Apps (collectively, the “Service”). Note this Privacy Notice does not address our privacy practices relating to ShiftPosts employees and other personnel.

A user of the Services is hereinafter referred to as a “User,” or collectively, the “Users.” Users can include individuals such as website visitors, pharmacy professionals seeking shifts (“Pharmacy Professionals”) and pharmacy owners and managers seeking help for shifts (“Pharmacies”).

We encourage you to review our Terms of Service because they contain important information about your use of the Service.

Personal Information Collection 

We may collect your personal information from you and other sources for various purposes to provide and improve our Service to you.

Personal Information You Provide to Us: 

We may collect any personal information you provide to us when, you use the Service. The types of personal information we may collect may include:

  • Contact information, including your first and last name, email address, phone number, and postal address. 

 

  • Account information, including username, password, profile picture, and account configurations. 

 

  • Pharmacy Professionals information and license verification, including first and last name, address, license number and expiration, license province or license state, license photograph, year of graduation, infractions (from licensing association), training, background checks, Social Security number, date of birth, driver’s license, physical and health-related information, COVID-19 screening and vaccination information, Worker ID, shift and Pharmacy locations and preferences, historical employment information, reference information, language information, education, gender, race, information you provide in chats, and any other information provided to us in your application or through our Services. Please note that while ShiftPosts may collect sensitive data such as Social security number and government-issued identification, such as driver’s license, for license verification purposes, ShiftPosts deletes such information once verification has been completed. 

 

  • Pharmacies Information, including first and last name, company and pharmacy name, job position, email address, company and pharmacy postal address, company and pharmacy phone number, pharmacy association, pharmacy ID number, pharmacy accreditation number, username, profile information, billing information, and any other information provided to us in your application or through the Services. 


  • Payment information, including credit or debit card number, expiration date, security code, and billing address. Please note we collect and process all financial information, such as credit card numbers, through third-party payment processing providers including Stripe.   • Inquiry information and communications, including the contents of emails, texts, and other communications with us. This information may include your full name, email address, and any other information you choose to provide to us.


  • Reviews, Surveys, and Testimonial Information, including information provided in any questions submitted through surveys, or content of any testimonials.

Where an individual chooses to contact us, we may need additional information to fulfill their request or respond to their inquiry. We may provide additional privacy disclosures where the scope of the inquiry/request or the personal information we require fall outside the scope of this Privacy Notice. In that case, the additional privacy disclosures will govern how we may process the information the individual provides at that time.

Personal Information We Automatically Collect:

As is true of most digital platforms, we and our third-party providers may also collect personal information from an individual’s device, browsing actions and website usage patterns automatically when visiting or interacting with our Service, which may include log data (such as internet protocol (IP) address, operating system, browser type, browser id, the URL entered and the referring page/campaign, date/time of visit, the time spent on our Service and any errors that may occur during the visit to our Service), analytics data (such as the electronic path taken to our Service, through our Service and when exiting our Service, as well as usage and activity on our Service such as the pages you view, the links you click, features an functionalities you utilize, how frequently you access the Service, the site form which you came and the site to which you are going when you leave the Service, whether you open emails or click on the links contained in emails, whether you access the services from multiple devices, or other actions you take on the Service.); and location data (such as general geographic location based on the log data we or our third-party providers collect). 

We and our third-party providers may use (i) cookies or small data files that are stored on an individual’s computer and (ii) other, related technologies, such as web beacons, pixels, embedded scripts, location-identifying technologies and logging technologies (collectively, “cookies”) to automatically collect this personal information. For example, our Sites use Google Analytics, a web analytics service provided by Google LLC (“Google”), to collect and view reports about the traffic on our Sites. To manage cookies, an individual may change their browser settings to: (i) notify them when they receive a cookie, so the individual can choose whether or not to accept it; (ii) disable existing cookies; or (iii) automatically reject cookies. Please note that doing so may negatively impact an individual’s experience using our Service, as some features and offerings may not work properly or at all. Depending on an individual’s device and operating system, the individual may not be able to delete or block all cookies. In addition, if an individual wants to reject cookies across all browsers and devices, the individual will need to do so on each browser on each device they actively use. An individual may also set their email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether they have accessed our email and performed certain functions with it.

Personal Information from Other Sources:

We also obtain personal information from other sources, which we often combine with personal information we collect either automatically or directly from individuals. We receive the same categories of personal information as described above from the following sources and third parties:

  • Affiliates: We may receive personal information from other companies owned or controlled by ShiftPosts, and other companies owning or under common ownership with ShiftPosts. This includes any subsidiaries (i.e., any organization we own or control) or our parent company (i.e., any organization that owns or controls us) and any subsidiaries it owns. 

 

  • Your Employer / Company: When an individual interacts with our Services as an employee or representative of their company, we may receive their information from their employer or other employees at their company.


  • Other Users: When you interact with other Users on the Services we may receive information you choose to share with them. For example, if you send a direct message to another User, we may receive the information in the message. We also may receive ratings and comments from other Users. For example, we receive ratings from Pharmacy Professionals and Pharmacies after shifts are completed.


  • Application-Related Third Parties: When you submit an application to be a Pharmacy Professional, we may receive personal information from related third parties, such as job application platforms, references, background check providers, and recruiters.


  • Certification and Licensing Boards: We may receive information from third parties in order to verify your certifications or licenses.


  • Social Media: When you interact with our Services through various social media networks, such as when you log in through a social network, “Like” us on Facebook or follow us or share our content on Google, LinkedIn, Facebook, Twitter, or other social networks, we may receive some information about you that you permit the social network to share with third parties. The data we receive is dependent upon your privacy settings with the social network. You should always review and, if necessary, adjust your privacy settings on third-party websites and social media networks and services before sharing information and/or linking or connecting them to other services.


  • Service Providers: Our service providers that perform services solely on our behalf, such as email marketing providers, cloud providers, IT services, employment verification providers, and payment processors, collect personal information and often share some or all of this information with us in connection with facilitation of our services. 

 

  • Information Providers: We may from time to time obtain information from third-party information providers from whom you have permitted to share your personal information, including marketing providers. We use this information to correct or supplement other personal information we collect. 

 

  • Publicly Available Information: We may also collect personal information from publicly available sources, such as government records or publicly available websites, to supplement other personal information we collect. 


Only authorized ShiftPosts staff have access to your personal information in its entirety. Other staff may have access to portions of this information if it pertains to their job duties.

Use of Personal Information

We may use the personal information we collect to:

  • to fulfill or meet the reason the information was provided, such as to fulfill our contractual obligations, to provide our products and the Services, and to process transactions;

 

  • to manage our organization and its day-to-day operations;

 

  • to evaluate your application to become an active Pharmacy Professional or Pharmacy;

 

  • to request individuals to complete surveys about our organization, organizations we partner with, Pharmacy, and the Services;

 

  • to offer incentives to Users in the marketplace;

  • to determine whether Pharmacy Professionals are at the Pharmacies during their shifts,

  • to suggest and display nearby available shifts,

  • for billing, payment, identification and authentication, and fraud prevention,

  • to identify and analyze how individuals use our Site and Services and to conduct research and analytics on our User base and our Services,

  • to improve and customize our products and the Services to address the needs and interests of our User base and other individuals we interact with,

  • to communicate with you, including via email, push notification, text message, social media and/or telephone calls, and to deliver administrative notices and communications relevant to your use of our products and the Services,

  • for marketing and advertising purposes, including to market to you or offer you through email, direct mail, phone or text message information and updates on products, services or events we think you may be interested in,

  • to administer, improve and personalize our Services, including by recognizing an individual and remembering their information when they return to our Site,

  • to facilitate User benefits and services, including customer support through our command center services,

  • for internal market research, 

  • to test, enhance, update and monitor the Services, or diagnose, fix or troubleshoot technology problems,

  • to help maintain the safety, security and integrity of our property and Services, technology assets and business,

  • to detect, investigate, provide notice of or protect against error, fraud or other unlawful or criminal activity,

  • To exercise or comply with our legal obligations or rights and our policies; and

 

  • To protect the safety, rights, property, or security of ShiftPosts, our users, employees, third parties, members of the public and/or the Service.

 

  • We may also use the information we collect for any other purpose with your consent. 

We may aggregate, de-identify and/or anonymize any information collected through the Service so that such information is no longer reasonably capable of being associated with you. We may use aggregated or anonymized information for any purpose, including for research and marketing purposes, and we may also share such information for any purpose with any third parties, at our discretion.

For the purposes discussed in this Privacy Notice, we may combine the information that we collect through the Service with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Notice.

How We Share Your Personal Information

We may share your personal information under the following circumstances: 

  • Affiliates: We may share your personal information among our affiliates, including other companies owned or controlled by ShiftPosts and other companies owning or under common ownership with ShiftPosts, for business purposes. 

 

  • Survey Providers, Sponsors, and Partners: We share personal information with third parties who assist us in delivering our survey offerings and processing the responses. We also may share information with promotional providers and partners. Some ShiftPosts content is “sponsored by” or “presented by” other companies. ShiftPosts shares market research data (how the sponsorship performed, etc.) collected on this Site, the Services, or via email surveys with these partners. This information is usually in aggregate form. Partners may sponsor promotions that require you to reveal details such as your name, address or phone number. Always check their privacy policy before revealing information about yourself. If you don’t want these sponsors to have your personal information, you can choose to not participate.


  • Your Employer / Company: When an individual interacts with our Services as an employee or representative of their company, we share their information with their employer or other employees at their company.


  • Other Users: We may share your personal information with other Users. For example, if you are a Pharmacy Professional who signs up for a shift at a Pharmacy, we may share your information with that Pharmacy.

 

  • Marketing Providers: We coordinate and share personal information with our marketing providers in order to communicate with individuals about the Services we make available.

 

  • Customer Service and Communication Providers: We share personal information with third parties who assist us in providing our customer services and facilitating our communications with individuals that submit inquiries.


  • Other Service Providers: In addition to the third parties identified above, we engage other third-party service providers that perform business or operational services for us or on our behalf, such as payment processing, website hosting, infrastructure provisioning, IT services, analytics services, administrative services.


  • Business Partners: We may share limited personal information, such as your phone number, with our business partners and pharmacy services providers, who may use this information for their own business and commercial purposes in accordance with their own privacy policies. You may be given the option to opt-out of such sharing, consistent with the laws of the applicable jurisdiction. 


  • Business Transaction or Reorganization. We may also share your information if we sell, transfer, or otherwise share some or all of our assets to a third party in connection with a merger, acquisition, reorganization, sale of assets or similar transaction, or in the event of a bankruptcy, or in diligence leading up to a potential corporate transaction. We may disclose personal information to a third party during negotiation of, in connection with, or as an asset in such a corporate business transaction. 

 

  • As Required or Permitted by Law: We may disclose your personal information as we, in our sole discretion, believe necessary or appropriate to: comply with a legal obligation; protect and defend the rights or property of ShiftPosts; prevent or investigate possible wrongdoing in connection with the Service; protect the personal safety of users of the Service or the public; protect against legal liability; or otherwise comply with the law. 

 

  • Otherwise With Your Consent or At Your Direction: We may disclose your information where we have your consent, or you direct us to do so. For example, with an individual’s consent or direction we may post their testimonial on our Site or service-related publications.

We may also share information with others in de-identified, aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.  

Third-Party Tracking and Online Advertising

We may share, or we may permit third-party online advertising networks, social media companies, and other third-party services, to collect information about your use of our Site over time so that they may play or display ads that may be relevant to your interests on other websites or apps, or on other devices you may use. Typically, though not always, the information we share is provided through cookies or similar tracking technologies, which recognize the device you are using and collect information, including hashed data, clickstream information, browser type, time and date you visited the website and other information. This information is used to display targeted ads on or through our services or on other websites, apps, or services. We or the online advertising networks use this information to make the advertisements you see online more relevant to your interests. We may also display targeted advertising to you through social media platforms, such as LinkedIn, Facebook, TikTok, Twitter, Google, Pinterest, and others. These companies have interest-based advertising programs that allow us to direct advertisements to users who have shown interest in our services or our clients’ services while those users are on the social media platform, or to groups of other users who share similar traits, such as likely commercial interests and demographics. These advertisements are governed by the privacy policies of those social media companies that provide them.

Google Analytics and Advertising. We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to our services. 

You may control your advertising preferences or opt-out of certain Google advertising products by visiting the Google Ads Preferences Manager, currently available at https://google.com/ads/preferences.  

To learn more about interest-based advertising and how you may be able to opt-out of some of this advertising, you may wish to visit the Digital Advertising Alliance’s (DAA) resources and/or the Network Advertising Initiative’s (NAI) online resources, at www.aboutads.info/choices or http://www.networkadvertising.org/choices/ and you can opt-out of receiving some interest-based advertisements on mobile apps by visiting http://www.aboutads.info/appchoices. You may also be able to limit interest-based advertising through the settings menu on your mobile device by selecting “limit ad tracking” (iOS) or “opt-out of interest-based ads” (Android).  

Please note that when you opt out of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our online services. It means that the online ads that you do see from DAA program participants should not be based on your interests. We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs. In addition, third parties may still use cookies to collect information about your use of our online services, including for analytics and fraud prevention as well as any other purpose permitted under the DAA’s Principles.   

Control Over Your Information

Modifying Your Information. You may modify certain information in your account, such as your address and skills, through your Profile Settings page on the Site or through the App. To update information related to your license, please contact us at: 1-844-SHIFT-01 (1-844-744-3801). If you have questions about reviewing or changing your information, you can contact us directly at support@shiftposts.com. We may not be able to modify your information in all circumstances.  

Deleting Your Account. You may request to delete your account through the account profile settings of the mobile App or by submitting the online form available here. Account deletion is permanent and cannot be undone. We may ask you to verify your identity before we process your request. In certain circumstances, we may not be able to respond to your request if we are not able to verify your identity or authority to make the request If you have a pending transaction, shift obligation, or money transfer pending at the time you request to delete your account, your access to the Service from ShiftPosts will terminate but your pending transaction will continue to completion before your account is deleted. We may not be able to delete your account in all circumstances. 

Access to Your Device Information. You may control the App’s access to your device information through your “Settings” app on your device. For instance, you can withdraw permission for the App to access your location, camera roll and camera.

How to Control Your Email Communications Preferences. You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).

Push Notifications. You can stop receiving push notifications from us by changing your preferences in your device’s notifications settings menu.   

California’s “Shine the Light” Opt Out. California’s “Shine the Light” law (Civil Code Section §1798.83) provides certain rights to California residents that have an established business relationship with us with regard to the disclosure of certain types of personal information to third parties for their direct marketing purposes. To opt-out of having your personal information disclosed to third parties for their direct marketing purposes, please email us at support@shiftposts.com.

Links To Third-Party Sites

Our Service may contain links to other sites, plug-ins, and applications that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Children’s Privacy

Our Service is not directed to children under the age of 18, and ShiftPosts does not knowingly collect personal information from anyone under the age of 18. If you are aware that a child has provided us with personal information, please contact us. We will take steps to remove that information from our servers.

Changes To This Privacy Notice

We may update our Privacy Notice from time to time. We will notify you of any changes by posting the new Privacy Notice on this page. We will let you know via email, by placing a prominent notice on our Service, or through any other reasonable means prior to the change becoming effective and update the “effective date” at the top of this Privacy Notice. You are advised to review this Privacy Notice periodically for any changes. Changes to this Privacy Notice are effective when they are posted on this page.
